§ 1 Scope of Application

(1) These General Terms and Conditions apply to all contracts concluded between ISOCO Plastics Technology GmbH, Eisenwerkstraße 7, 07318 Saalfeld/Saale, Germany (hereinafter referred to as the “Seller”) and consumers via the online shop.

(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

(3) Any conflicting or deviating terms of the customer shall not apply unless expressly accepted by the Seller in writing.

§ 3 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

(2) By clicking the button “Place Order with Obligation to Pay”, the customer submits a binding offer to conclude a purchase contract.

(3) The automatic confirmation of receipt of the order does not constitute acceptance of the offer.

(4) A contract is concluded only upon:

  • express order confirmation by the Seller; or

  • dispatch of the goods.

(5) For countries for which no shipping costs are configured in the online shop, or where the order exceeds the available shipping limits, a contract shall only be concluded after an individual review of shipping options and an explicit order confirmation by the Seller.

§ 4 Prices, VAT and Shipping Costs

(1) Prices are displayed in Euro or, where applicable, in the local currency supported by the online shop.

(2) The online shop is intended for both consumers and business customers. Product prices may therefore be displayed both excluding VAT (net) and including VAT (gross).

(3) For consumers, only the displayed gross price including applicable VAT shall be binding.

(4) During promotions and sales campaigns, comparison prices or strike-through prices may be displayed on a net basis for technical reasons. The displayed sales price including applicable VAT shall always be the binding final price for consumers.

(5) Shipping costs are displayed separately during the checkout process.

(6) For certain countries, prices may be automatically converted into the respective local currency by the technical infrastructure of the online shop.

(7) Such currency conversions are performed automatically based on exchange rates and rounding mechanisms determined by the shop system or connected payment service providers.

(8) The final price displayed during checkout immediately before submitting the order shall be decisive for the contract.

(9) Variations resulting from exchange rate fluctuations, rounding differences or technical currency conversions shall not constitute a defect and shall not entitle the customer to claim a price adjustment.

(10) Deliveries outside the European Union may be subject to customs duties, import VAT, taxes or other charges which shall be borne by the customer.

§ 5 Payment Terms

(1) Available payment methods are displayed during the checkout process.

(2) The Seller reserves the right to restrict individual payment methods.

(3) Consumers may generally use:

  • PayPal

  • Credit Card

  • Apple Pay

  • Google Pay

  • Shop Pay

  • Klarna (where available)

  • Advance Payment

(4) Purchase on invoice is generally not available for consumers.

§ 6 Delivery

(1) Delivery shall be made to the delivery address specified by the customer.

(2) Delivery times are indicated in the respective product descriptions.

(3) Partial deliveries are permissible where reasonable for the customer.

(4) If a product is unavailable, the customer shall be informed without undue delay and any payments already made shall be refunded promptly.

§ 7 Transfer of Risk

The risk of accidental loss or deterioration of the goods shall pass to the customer only upon delivery of the goods to the customer or a person designated by the customer.

§ 8 Retention of Title

The goods shall remain the property of the Seller until full payment has been received.

§ 9 Product Characteristics

(1) The containers, storage systems, transport solutions and logistics products offered by the Seller are primarily designed for industrial and commercial applications.

(2) Suitability for a particular purpose shall only be deemed agreed if expressly confirmed by the Seller.

(3) Product images are for illustrative purposes only and may differ slightly from the delivered products.

(4) Minor technical modifications, production-related dimensional tolerances, colour deviations, gloss level differences, batch-related variations and material-specific characteristics of plastic products shall not constitute defects, provided that the functionality of the product is not materially impaired.

(5) Load capacities and performance specifications apply only under the conditions stated by the Seller.

§ 10 B-Grade Products

(1) Products designated as B-grade products may exhibit cosmetic or technical deviations from the regular production standard.

(2) Such deviations may include, in particular:

  • colour variations;

  • printing defects;

  • surface imperfections;

  • production-related dimensional deviations;

  • other cosmetic imperfections.

(3) The specific characteristics described in the product description shall constitute the agreed product condition.

(4) Statutory warranty rights regarding defects not expressly disclosed shall remain unaffected.

§ 11 Right of Withdrawal

(1) Consumers are entitled to the statutory right of withdrawal.

(2) Details are set out in the separate Withdrawal Policy.

(3) Withdrawal may be exercised in text form or via the electronic withdrawal function provided by the Seller.

§ 12 Warranty

Statutory warranty rights shall apply.

§ 13 Liability

(1) The Seller shall have unlimited liability:

  • in cases of intent or gross negligence;

  • for injury to life, body or health;

  • under the German Product Liability Act;

  • to the extent of any expressly assumed guarantee.

(2) In the event of a slightly negligent breach of essential contractual obligations, liability shall be limited to the foreseeable damage typical for the contract.

(3) Essential contractual obligations are obligations whose fulfilment is necessary for the proper performance of the contract and on whose compliance the customer may regularly rely.

(4) Any further liability shall be excluded to the extent permitted by law.

§ 14 Consumer Dispute Resolution

ISOCO Plastics Technology GmbH is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 15 Governing Law

(1) The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).

(2) Mandatory consumer protection provisions of the country in which the consumer has their habitual residence shall remain unaffected.

§ 16 Language Versions

(1) The contractual language is German.

(2) These Terms and Conditions may be provided in additional languages for informational purposes only.

(3) The German version shall be the sole legally binding version governing the contractual relationship.

(4) In the event of any discrepancy, inconsistency, contradiction or interpretation difference between the German version and any translation, the German version shall prevail.

§ 17 Severability

Should any provision of these Terms and Conditions be wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
